The civil appeals arose from a common order of the Gujarat High Court Division Bench which confirmed a Single Judge's decision that respondents holding BAMS (Bachelor of Ayurved in Medicine and Surgery) degrees should be treated at par with MBBS doctors and are entitled to benefits of the Tikku Pay Commission recommendations. The Supreme Court examined the genesis of the Tikku Committee, which was constituted on 03.05.1990 pursuant to a Memorandum of Settlement dated 21.08.1989 between the Ministry of Health and Family Welfare and the Joint Action Council of Service Doctors Organisation. The Committee held 30 meetings from June to October 1990 and submitted its report on 31.10.1990. The recommendations were expressly confined to service doctors holding MBBS degrees, post-graduate medical degrees, and degrees in super-specialities, covering both teaching and non-teaching sides. By a separate order dated 19.11.1990, another High-Power Committee was constituted under the same chairman for other categories. The Court held that the Tikku Committee's recommendations did not extend to BAMS degree holders, and therefore the High Court erred in granting parity. The appeals were allowed, setting aside the impugned orders.
