At the instance of the accused, an order of transfer of a complaint under Section 138 of the Negotiable Instruments Act, 1881, cannot be issued. The petitioner has the option to apply for exemption from personal appearance in the concerned Court. In light of these observations, the Transfer Petition is dismissed. Consequently, any pending applications are disposed of accordingly.
