Case Note & Summary

The Supreme Court heard an appeal against the refusal of pre-arrest bail by the Punjab and Haryana High Court. The appellants, Sunita Devi and another, were accused of cheating in connection with land transactions. They had joined the investigation and cooperated, which was not disputed by the State. The Court considered that custodial interrogation was not necessary at this stage given their cooperation. The Court set aside the High Court's order and granted pre-arrest bail, directing that the appellants be released on bail in the event of arrest on terms to be fixed by the trial court. The Court also noted that if the appellants fail to cooperate in the future, the State may seek cancellation of bail. The appeals were allowed accordingly.
