Case Note & Summary

The dispute involved a transfer petition filed by the petitioner-wife seeking to relocate divorce proceedings initiated by the respondent-husband. The divorce petition was originally filed in the Court of Principal Judge, Family Court, Varanasi, and the wife sought its transfer to the Family Court, Muzaffarpur, Bihar. The Supreme Court had earlier directed the parties to explore settlement through mediation at the Supreme Court Mediation Centre, but the mediation report dated October 5, 2019, indicated that no mutually acceptable settlement terms were reached. The core legal issue was whether the transfer of the divorce petition was justified based on the convenience of the parties. The wife's counsel likely argued for transfer to reduce hardship, while the husband's counsel may have opposed it, though specific arguments were not detailed in the judgment. The court analyzed the facts and circumstances on record, emphasizing the need to facilitate the parties, particularly the respondent who had to travel to attend proceedings. The court reasoned that transfer would serve the interests of justice and convenience. Consequently, the court allowed the transfer petition, ordering the divorce petition (No. 1299/2017) to be transferred from Varanasi to Muzaffarpur. The court directed the Varanasi court to transmit the entire record immediately and instructed the Muzaffarpur court to fix hearing dates convenient for the parties and to decide the case expeditiously within one year from receipt of the order copy. The registry was directed to send the order to both courts via email for compliance.
