Case Note & Summary
The Supreme Court of India heard two sets of civil appeals concerning land acquisition compensation disputes. The appellants were landholders whose lands in villages Shaikh Roza, Jafrabad, and Taj Sultanpur had been acquired by the Deputy Chief Engineer (Constructions), South Central Railways-III, Secunderabad, and Union of India. The lands were acquired under the Land Acquisition Act, 1894, with compensation initially determined by the Land Acquisition Officer at varying rates per acre for different villages. Reference Applications led to enhanced compensation by the Reference Court, and previous appeals before the Supreme Court had resulted in final determinations of Rs.150 per sq. ft. for Shaikh Roza lands and Rs.129.95 per sq. ft. for Jafrabad lands. In the first set of appeals, the appellants argued that compensation for Taj Sultanpur lands should be raised to the same level as Jafrabad, as both villages had been treated similarly. The Railways opposed this. The court, considering the entirety of the matter and the extent of acquisition, held that justice required parity and directed compensation for Taj Sultanpur at Rs.129.95 per sq. ft. In the second set of appeals, involving lands from Taj Sultanpur acquired under a later notification issued five years after the previous one, the court adopted the methodology used by the High Court and lower courts: taking the base value from the earlier acquisition and applying a 10% annual accretion. With a five-year delay, this resulted in a 50% enhancement, leading to an award of Rs.195 per sq. ft. The appeals were allowed without costs, ensuring uniform compensation rates and proper valuation for delayed acquisitions.
Headnote
A) Land Acquisition - Compensation Determination - Uniform Rates for Similarly Situated Lands - Land Acquisition Act, 1894, Section 4 - Appellants sought parity in compensation rates for lands from village Taj Sultanpur with those from village Jafrabad, which were treated at same level in previous acquisition - Court directed compensation for Taj Sultanpur lands at Rs.129.95 per sq. ft., same as Jafrabad, to meet ends of justice considering extent of acquisition (Paras 2-4). B) Land Acquisition - Compensation Calculation - Accretion at 10% Per Annum for Delayed Acquisition - Land Acquisition Act, 1894, Section 4 - For lands acquired under a later notification five years after previous acquisition, Court adopted methodology of taking base value from earlier acquisition and granting 10% annual accretion - Awarded Rs.195 per sq. ft. (50% enhancement over base of Rs.129.95) for Taj Sultanpur lands in instant matter (Paras 5-6).
