The lands were acquired under the Land Acquisition Act, 1894, with compensation initially determined by the Land Acquisition Officer at varying rates per acre for different villages. Reference Applications led to enhanced compensation by the Reference Court, and previous appeals before the Supreme Court had resulted in final determinations of Rs.150 per sq. ft. for Shaikh Roza lands and Rs.129.95 per sq. ft. for Jafrabad lands. In the first set of appeals, the appellants argued that compensation for Taj Sultanpur lands should be raised to the same level as Jafrabad, as both villages had been treated similarly. The Railways opposed this. The court, considering the entirety of the matter and the extent of acquisition, held that justice required parity and directed compensation for Taj Sultanpur at Rs.129.95 per sq. ft. In the second set of appeals, involving lands from Taj Sultanpur acquired under a later notification issued five years after the previous one, the court adopted the methodology used by the High Court and lower courts: taking the base value from the earlier acquisition and applying a 10% annual accretion. With a five-year delay, this resulted in a 50% enhancement, leading to an award of Rs.195 per sq. ft. The appeals were allowed without costs, ensuring uniform compensation rates and proper valuation for delayed acquisitions.

We, therefore, allow these appeals and direct as under: (a) In respect of lands coming from village Shaikh Roza, the appellants shall be entitled to compensation @ Rs.150 per sq. ft. as was awarded to other lands from the same village. Considering the entirety of the matter and the extent of land under acquisition, in our view, the ends of justice would be met if the compensation in respect of lands from Taj Sultanpur is put at the same level as was awarded in respect of lands of the village Jafrabad. Adopting the same methodology, in our view, the base value for lands from the village Taj Sultanpur has to be taken at the level of Rs.129.95 per sq. ft. Considering enhancement @ 10% per annum, enhancement to the tune of 50% has to be awarded in the present matter.
