Case Note & Summary

The appellant, Adani Gas Limited, was involved in setting up Natural Gas Distribution Networks in India. The dispute concerned Gas Distribution Networks in Udaipur and Jaipur, Rajasthan. On 19.11.2005, the Government of Rajasthan invited bids for laying gas distribution networks. The appellant submitted an Expression of Interest and was granted a No Objection Certificate (NOC) on 27.03.2006 after depositing a commitment fee of Rs. 2 Crore. The Petroleum and Natural Gas Regulatory Board Act, 2006 was notified on 03.04.2006 but came into force on 01.10.2007 (appointed day). Section 16 (authorisation) was brought into force on 15.07.2010. The appellant applied for authorisation under Section 16 on 21.07.2007 and 24.07.2007, claiming deemed authorisation under the proviso to Section 16. The Board issued a press note on 30.10.2007 requiring entities to furnish particulars. The appellant submitted details on 07.12.2007. On 19.03.2008, the 2008 Regulations were notified. Regulation 18 required entities to apply for authorisation. The appellant applied on 28.08.2008. On 18.05.2011, the Government of Rajasthan withdrew the NOC and forfeited the commitment fee, citing non-fulfilment of conditions. On 19.05.2011, the Board rejected the appellant's authorisation application, citing insufficient progress and violation of directions. The appellant challenged these orders and the vires of Regulation 18 before the Rajasthan High Court, which dismissed the writ petition on 29.04.2015. The Supreme Court dismissed the appeal, holding that the appellant was not entitled to deemed authorisation as it had not completed the network before the appointed day; Regulation 18 was valid; and the withdrawal of NOC and forfeiture were justified.
