Case Note & Summary

The dispute in this appeal pertains to the inter se seniority of the appellant and the 5th respondent, both appointed as Assistant Teachers in a secondary school in Maharashtra, governed by the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981. The appellant was appointed as an untrained teacher on 15th July 1994 and later acquired B.Ed. qualification on 19th September 1997, thereby becoming a trained teacher. The 5th respondent was appointed as a trained teacher on 13th August 1997, holding B.A., B.Ed. qualifications at the time of appointment. The Education Officer, as the competent authority under Rule 12(3) of the Rules, determined that the 5th respondent was senior to the appellant in Category 'C' of Schedule 'F' because he entered that category on his appointment date, whereas the appellant entered Category 'C' only upon acquiring B.Ed. qualification on 19th September 1997. The High Court upheld this decision. The appellant argued that her earlier appointment as untrained teacher should give her seniority, and that the 5th respondent being a temporary teacher could not claim seniority until confirmed. The Supreme Court, after examining the scheme of Rules 1981, particularly Rule 12 and Schedule 'F', held that seniority is determined based on the date of entry into a particular category as per qualifications, not on the date of initial appointment in a lower category. Since the 5th respondent entered Category 'C' on 13th August 1997, earlier than the appellant's entry on 19th September 1997, he is senior. The Court dismissed the appeal, finding no merit in the appellant's contentions.

Nature of Litigation

Civil appeal against the judgment of the High Court dismissing the writ petition challenging the order of the Education Officer regarding inter se seniority of teachers.

Remedy Sought

The appellant sought to set aside the order of the Education Officer and the High Court judgment, claiming seniority over the 5th respondent.

Filing Reason

The appellant was aggrieved by the determination of seniority by the Education Officer, which placed the 5th respondent senior to her.

Previous Decisions

The Education Officer, by order dated 31st March 2003, held that the 5th respondent is senior to the appellant in Category 'C' of Schedule 'F'. The High Court dismissed the writ petition filed by the appellant, upholding the Education Officer's order.

Issues

Whether the appellant, who was appointed as an untrained teacher earlier but acquired B.Ed. qualification later, is entitled to seniority over the 5th respondent who was appointed as a trained teacher later but entered the same category earlier.

Submissions/Arguments

Appellant: Seniority should be based on longer officiation in the cadre; acquiring B.Ed. later should not take away her right of seniority under Rule 12; the 5th respondent being a temporary teacher cannot claim seniority until confirmed. Respondent: The 5th respondent was appointed as a trained teacher and entered Category 'C' on his appointment date, while the appellant entered Category 'C' only after acquiring B.Ed.; seniority is correctly determined by the date of entry into the category.

Ratio Decidendi

Under Rule 12 read with Schedule 'F' of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981, seniority of teachers is determined based on the date of entry into a particular category as per qualifications, not on the date of initial appointment in a lower category. A teacher who enters a higher category later cannot claim seniority over a teacher who entered that category earlier, even if the former had earlier service in a lower category.

Judgment Excerpts

The dispute in this appeal pertains to the inter se seniority of the appellant vis-a-vis 5th respondent, who were appointed as Assistant Teacher in Secondary School and their services are governed by the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981. The Competent Authority adverted to the rival claims of the parties and observed in its order dated 31st March, 2003 holding that the 5th respondent was appointed on 13th August, 1997 as a trained teacher holding the qualification of B.A. B.Ed. and at the time of entry into service, he was in category table ‘C’. At the same time, the appellant although was appointed as Assistant Teacher (untrained) with effect from 15th July, 1994 but she qualified her B.Ed on 19th September, 1997 and became member of category table ‘C’ only on acquiring qualification of B.Ed. and accordingly the 5th Respondent became senior to the appellant in category ‘C’ to Schedule ‘F’ annexed to Rule 12 of Rules, 1981.

Procedural History

The Education Officer passed an order on 31st March 2003 determining inter se seniority. The appellant filed a writ petition in the High Court, which was dismissed. The appellant then filed a Special Leave Petition in the Supreme Court, which was converted into Civil Appeal No. 11934 of 2018.
