Case Note & Summary

The appellant purchased property in 1994 and claimed possession. He filed a suit for permanent injunction (CS No.1069 of 2003) which was dismissed, and later a suit for specific performance (CS No.2929 of 2010) which was pending. The respondent filed an application under Section 41 of the Presidency Small Causes Courts Act, 1882 (P.S.R.P. No.22 of 2011) seeking vacant possession. The appellant filed an application under Section 47 of the Act seeking stay, which was rejected by the Small Causes Court on 28.01.2013. The appellant challenged this rejection before the Gujarat High Court in Special Civil Application No.10271 of 2013. The High Court dismissed the application and directed the appellant to vacate the premises. The Supreme Court held that since no order under Section 41 or 43 of the Act had been passed by the Small Causes Court, the High Court erred in issuing a direction to vacate. The Supreme Court set aside that direction, leaving all contentions open, and directed the Small Causes Court to decide the respondent's application expeditiously within three months.

Headnote

A) Civil Procedure - High Court's Power under Article 227 - Scope of Interference - The High Court, while exercising jurisdiction under Article 227 of the Constitution, cannot issue directions beyond the scope of the proceedings before it, especially when no final order has been passed by the subordinate court under the relevant provisions of the Presidency Small Causes Courts Act, 1882. (Paras 7-8)

B) Presidency Small Causes Courts Act, 1882 - Sections 41 and 43 - Eviction Order - Requirement of Final Order - No direction for eviction can be issued by the High Court under Article 227 when the Small Causes Court has not passed any order under Section 41 or 43 of the Act. The High Court exceeded its jurisdiction by directing the appellant to vacate the premises. (Paras 7-8)

C) Civil Procedure - Interim Relief - Pending Suit - The pendency of a suit for specific performance does not justify a direction to vacate the premises in a separate proceeding under the Presidency Small Causes Courts Act, 1882, without a final order of eviction. (Paras 7-8)

Nature of Litigation

Civil appeal against High Court order in a special civil application under Article 227 arising from proceedings under the Presidency Small Causes Courts Act, 1882.

Remedy Sought

Appellant sought setting aside of the High Court's direction to vacate the premises.

Filing Reason

The High Court directed the appellant to vacate the premises despite no eviction order under Section 41 or 43 of the Act.

Previous Decisions

Small Causes Court rejected appellant's application under Section 47 of the Act on 28.01.2013; High Court dismissed the special civil application and directed vacating of premises on 19.06.2018.

Issues

Whether the High Court could direct the appellant to vacate the premises when no order under Section 41 or 43 of the Presidency Small Causes Courts Act, 1882 had been passed.

Submissions/Arguments

Appellant argued that the High Court erred in issuing a direction to vacate without any order under Section 41 or 43 of the Act. Respondent submitted that the application under Section 47 was rightly rejected and the High Court's order was correct.

Ratio Decidendi

The High Court, while exercising jurisdiction under Article 227, cannot issue directions to vacate premises when no final order under Section 41 or 43 of the Presidency Small Causes Courts Act, 1882 has been passed by the Small Causes Court. Such directions exceed the scope of the proceedings.

Judgment Excerpts

As much as no order is passed either under Section 41 or under Section 43 of the Act by the Small Causes Court, the High Court has committed error in issuing directions to the appellant to vacate the premises, which is subject matter of the petition. For the aforesaid reasons, the direction issued, in the impugned order to the extent of directing the appellant to vacate the premises, is hereby set aside.

Procedural History

Appellant filed suit for permanent injunction (CS No.1069 of 2003) which was dismissed. Filed suit for specific performance (CS No.2929 of 2010) pending. Respondent filed P.S.R.P. No.22 of 2011 under Section 41 of the Act. Appellant filed application under Section 47 which was rejected on 28.01.2013. Appellant filed Special Civil Application No.10271 of 2013 before Gujarat High Court, which was dismissed on 19.06.2018 with direction to vacate. Appellant appealed to Supreme Court.
