The appellant purchased property in 1994 and claimed possession. He filed a suit for permanent injunction (CS No.1069 of 2003) which was dismissed, and later a suit for specific performance (CS No.2929 of 2010) which was pending. The respondent filed an application under Section 41 of the Presidency Small Causes Courts Act, 1882 (P.S.R.P. No.22 of 2011) seeking vacant possession. The appellant filed an application under Section 47 of the Act seeking stay, which was rejected by the Small Causes Court on 28.01.2013. The appellant challenged this rejection before the Gujarat High Court in Special Civil Application No.10271 of 2013. The High Court dismissed the application and directed the appellant to vacate the premises. The Supreme Court held that since no order under Section 41 or 43 of the Act had been passed by the Small Causes Court, the High Court erred in issuing a direction to vacate. The Supreme Court set aside that direction, leaving all contentions open, and directed the Small Causes Court to decide the respondent's application expeditiously within three months.
