The Supreme Court allowed the appeal filed by the State Bank of India against the High Court order that had refused to return original documents deposited in a pending recovery application before the Debts Recovery Tribunal (DRT). The dispute arose from a loan default by M/s. Rukmini Mills Ltd., for which Associated Trading Corporation Pvt. Ltd. stood as guarantor by mortgaging its property. The bank declared the account as NPA and initiated proceedings under the SARFAESI Act, taking symbolic possession in 2008. The guarantor challenged the possession notice but failed. In 2017, the bank conducted an e-auction of the secured assets, and M/s. Tripower Enterprises Pvt. Ltd. emerged as the highest bidder, paying over Rs.60 crores. A sale certificate was issued. Meanwhile, the bank had filed a recovery application (O.A. No. 11/2008) before the DRT, in which it had deposited original title deeds (Exhibits A110-A114). The bank sought return of these documents to hand over to the auction purchaser. The DRT rejected the application, holding that the validity of the mortgage was still in issue and returning documents would prejudice adjudication. The DRAT reversed, allowing return of documents subject to retaining photocopies. The High Court restored the DRT order. The Supreme Court held that the bank is entitled to return of the original documents. The Court noted that the SARFAESI proceedings are independent of the OA, and the sale to the auction purchaser has been completed. The bank needs the documents to fulfill its obligation to the auction purchaser. The validity of the mortgage can still be decided by the DRT using photocopies. The Court set aside the High Court order and restored the DRAT order, directing the DRT to return the documents to the bank within two weeks.
