The appellant, Pratap Dandapani Padhi, a 43-year-old Mechanical Engineer working as a Foreman at Sunflag Iron & Steel Company Limited with a monthly salary of Rs.37,071/-, sustained grievous injuries in a motor vehicle accident on 20/5/2010 when his motorcycle was hit by a tipper truck. He suffered fractures and 70% permanent disability. He filed a claim petition before the Motor Accident Claims Tribunal, Bhandara, which awarded Rs.15,00,000/- as compensation. Dissatisfied, the appellant filed the present appeal seeking enhancement. The High Court noted that the Insurance Company did not challenge the award, and the only issue was quantum. The Court scrutinized the evidence, including medical reports and salary certificates. It found that the Tribunal had assessed loss of earning capacity at 50% but applied it incorrectly, and had awarded inadequate amounts for pain and suffering, medical expenses, and future prospects. The High Court recalculated the compensation: loss of earning capacity at Rs.15,58,800/- (using multiplier 14, 50% disability, and adding 50% future prospects), pain and suffering Rs.2,00,000/-, medical expenses Rs.1,50,000/-, future medical expenses Rs.1,00,000/-, loss of amenities Rs.1,00,000/-, and other heads Rs.1,00,000/-, totaling Rs.27,00,000/-. The Court directed the Insurance Company to pay the enhanced amount with interest at 7.5% per annum from the date of petition.
