The court analyzed the Recruitment Rules for the post of SSA, which required promotion from JSA, and the circular dated 13.05.2002, which granted higher pay scale to employees who were promoted. The court noted that the petitioners who were not promoted could not claim the higher pay scale merely because they were eligible for promotion. The court also considered the earlier award and High Court order, but found that they did not create a right for the petitioners to receive the higher pay scale without promotion.
