Case Note & Summary

The petitioners, eleven individuals appointed as Junior Scientific Assistants (JSA) with the Ahmedabad Municipal Corporation (AMC) between 1979 and 1989, filed a writ petition under Articles 14, 16, and 226 of the Constitution of India. They sought a writ of mandamus or certiorari to quash the impugned communication dated 09.03.2017 and to direct the AMC to grant them the higher pay scale of Rs. 2000-3200 instead of Rs. 1640-2900, with effect from 01.04.1992, along with consequential benefits and interest. The petitioners claimed that the next promotional post for JSAs was Senior Scientific Assistant (SSA), but only three of them (petitioners 1, 2, and 5) had been promoted to SSA. They relied on the AMC's circular dated 13.05.2002, which adopted the State of Gujarat's policy dated 16.08.1994 regarding higher pay scales, and on an earlier award by Arbitrator G.S. Barot and a High Court order in Special Civil Application No. 9949 of 1993. The AMC opposed the petition, arguing that the higher pay scale was linked to actual promotion to the post of SSA, and since most petitioners were not promoted, they were not entitled to it. The court analyzed the Recruitment Rules for the post of SSA, which required promotion from JSA, and the circular dated 13.05.2002, which granted higher pay scale to employees who were promoted. The court noted that the petitioners who were not promoted could not claim the higher pay scale merely because they were eligible for promotion. The court also considered the earlier award and High Court order, but found that they did not create a right for the petitioners to receive the higher pay scale without promotion. The court concluded that the impugned communication dated 09.03.2017, which rejected the petitioners' claim, was valid and did not warrant interference. The petition was dismissed with no order as to costs.

Nature of Litigation

Writ petition under Articles 14, 16, and 226 of the Constitution of India seeking higher pay scale.

Remedy Sought

Petitioners sought quashing of communication dated 09.03.2017 and direction to grant higher pay scale of Rs. 2000-3200 with consequential benefits.

Filing Reason

Petitioners, Junior Scientific Assistants, claimed entitlement to higher pay scale of Rs. 2000-3200 as per circular dated 13.05.2002, but the respondent Corporation rejected their claim.

Previous Decisions

Earlier, an Arbitrator's Award (Part-15) and High Court order in Special Civil Application No. 9949 of 1993 were relied upon by the petitioners.

Issues

Whether the petitioners are entitled to the higher pay scale of Rs. 2000-3200 without being promoted to the post of Senior Scientific Assistant? Whether the circular dated 13.05.2002 grants an automatic right to higher pay scale to all Junior Scientific Assistants?

Submissions/Arguments

Petitioners argued that as per the Recruitment Rules, the next promotional post is Senior Scientific Assistant, and they are entitled to higher pay scale of Rs. 2000-3200 as per circular dated 13.05.2002 adopting State policy. Respondent argued that the higher pay scale is linked to actual promotion to the post of Senior Scientific Assistant, and since most petitioners were not promoted, they are not entitled.

Ratio Decidendi

The higher pay scale of Rs. 2000-3200 is linked to actual promotion to the post of Senior Scientific Assistant. Mere eligibility for promotion does not entitle an employee to the higher pay scale without being promoted. The circular dated 13.05.2002 does not create an automatic right to higher pay scale for all Junior Scientific Assistants.
