Final Decision

The respondent insurance companies are directed to deposit the enhanced compensation amount with accrued interest within six weeks. The apportionment and disbursement shall be as per the Tribunal's order.

The appeal is filed by the claimant seeking enhancement of compensation. That on 11.05.2013 at about 4.30 p.m. when the claimant was proceeding to his native village Banavase... a Sand loaded lorry... came from Sakleshpura... with high speed and dashed against the car. The claimant was aged about 26 years as on the date of the accident and was a bachelor. The doctor assessed the disability to the whole body at 18%. Considering the year of accident i.e., 2013, the notional income of the claimant is assessed at Rs. 9,000/- per month. The claimant is entitled for 40% of the income towards future prospects. The compensation for loss of future income due to disability is calculated as Rs. 9,000 x 12 x 17 x 18% = Rs. 3,30,480/-. The compensation for pain and suffering is enhanced to Rs. 60,000/-. The compensation for loss of amenities is enhanced to Rs. 40,000/-. The compensation for attendant charges is enhanced to Rs. 20,000/-. The compensation for conveyance and nourishment is enhanced to Rs. 20,000/-. The compensation for loss of income during treatment is recalculated as Rs. 27,000/-. The rate of interest is enhanced to 7% per annum.
