Case Note & Summary

The State of Tamil Nadu appealed against the judgment of the Madras High Court which, while accepting that there was no legal impediment to extending OBC reservation to All India Quota seats surrendered by the State, directed implementation only from the next academic year. The State sought immediate implementation for the academic year 2020-2021. The Supreme Court heard arguments from both sides. The Union of India and National Medical Commission contended that the admission process was at an advanced stage, with NEET results declared and counseling about to commence. The Court noted that the process began in December 2019, applications were submitted, and candidates were unaware of OBC reservation in All India Quota. Implementing reservation now would require redoing the entire process, causing disruption. The Court dismissed the appeals, holding that it was not feasible to implement OBC reservation for the current academic year. The High Court's direction to constitute a committee for future implementation was upheld.

Headnote

A) Constitutional Law - Reservation - OBC Reservation in All India Quota - Tamil Nadu Backward Classes, Scheduled Castes and Scheduled Tribes (Reservation of seats in Educational Institutions and of appointments or posts in the services under the State) Act, 1993 - Implementation for current academic year - The Supreme Court considered whether OBC reservation could be implemented in All India Quota seats for the academic year 2020-2021. The Court held that at the advanced stage of the admission process, with NEET results declared and counseling scheduled, it would be difficult to implement reservation without disturbing the process. (Paras 8-9)

B) Constitutional Law - Reservation - All India Quota - Admission Process - Timing - The Court noted that the admission process commenced in December 2019, applications were filled, NEET exam was conducted on 13.09.2020, results announced on 16.10.2020, and counseling scheduled from 26.10.2020. Implementing OBC reservation at this stage would require redoing the process, causing complications. (Paras 8-9)

Nature of Litigation

Civil appeal against High Court judgment regarding implementation of OBC reservation in All India Quota medical seats.

Remedy Sought

Direction to implement OBC reservation in All India Quota seats for the academic year 2020-2021.

Filing Reason

Non-implementation of reservation for OBC candidates in medical seats contributed by State of Tamil Nadu to All India Quota.

Previous Decisions

Madras High Court held that there is no legal impediment to extending OBC reservation but directed implementation from next academic year after committee deliberation.

Issues

Whether OBC reservation can be implemented in All India Quota seats for the current academic year 2020-2021.

Submissions/Arguments

Appellant argued that reservation under the 1993 Act should apply to All India Quota seats and that admissions to under-graduate courses are at an early stage, so OBC candidates should not be deprived. Union of India contended that the admission process is at an advanced stage, with NEET results declared and counseling scheduled, and implementing reservation now would cause complications. National Medical Commission submitted that there is no OBC reservation in All India Quota except in Central Educational Institutions, and it is not possible to implement for this year due to the advanced process.

Ratio Decidendi

At an advanced stage of the admission process, with NEET results declared and counseling scheduled, implementing OBC reservation would disturb the entire process and cause complications. Therefore, no direction can be issued for the current academic year.

Judgment Excerpts

The only point that arises for consideration of this Court is whether a direction can be issued for implementation of the reservation to OBC candidates for admissions to under-graduate medical courses for this year. At present, reservation in the All India Quota seats has been provided only in favour of the Scheduled Castes, Scheduled Tribes and Physically Disabled candidates. If all the OBC candidates are now informed about the implementation of reservation for OBC candidates, the entire process has to be re-done which would disturb the counselling which is about to commence.

Procedural History

The State of Tamil Nadu and others filed writ petitions in the Madras High Court seeking implementation of OBC reservation in All India Quota medical seats. The High Court disposed of the petitions on 27.07.2020, holding that there is no legal impediment but directing implementation from the next academic year after a committee deliberation. The State appealed to the Supreme Court by way of Special Leave Petitions, which were converted into Civil Appeals.
